INSTRUCTIONS IN CASE OF ACCIDENT IN ALBANIA

  3. ALWAYS CARRY WITH YOU YOUR VEHICLE’S DOCUMENTATION AND INSURANCE POLICY

In case you are involved in a road accident you should:

  1. Help the injured and call the Police Authorities
  2. Get the registration plates of the vehicles, addresses of the drivers, witnesses and other people involved in the accident.
  3. Prepare an approximate sketch of the scene of the accident, showing clearly the position of the vehicles involved in the accident and other details if possible.
  4. Not take responsibility over the accident if you are not truly convinced you are liable for it. 
  5. Call and inform the nearest branch of your Insurance Company within three days from the date of accident.
  6. Take a copy of the Police Report of the Police Authorities.
  7. Ask to the liable driver to fill in a Cons tat Amiable or a declaration in which he accepts responsibility over the accident
  8. Not repair your vehicle without the permission of the Insurance Company you are insured by.

If the liable vehicle is uninsured at the moment of the accident or is insured with a green card, the claim shall be handled and settled by the Albanian Insurance Bureau.
The documentation of the claim for indemnification arising from the motor third party liability insurance policy, for damages caused to third parties from the usage of this vehicle contains general and specific documents divided in:

  1. Bodily injury
  2. Material damages
  3. Non-material damages

Documents that should be submitted in case of a Bodily Injury Claim
Documents in case of Bodily Injury are divided as below:
1. General documents
a. Notification/Claim for indemnification of the injured party registered in an Insurance Company
b. Confirmation of Insurance Cover, issued by the respective Insurance Company which has insured the liable vehicle.
c. The cons tat amiable or declaration of the event.
d. The Police Report on the occurrence issued by the competent Authorities the Road Traffic Police.
e. The Prosecution’s Office Verdict on the case, when from the accident resulted death and/or severe injuries.
f. The Verdict of the District Court, which defines liability over the accident , when one of the drivers of the vehicles involved in the accident results in death or severe injury, or the  Prosecution’s Office Verdict on the resting of the case.
2. Specific documents
a. Family certificate and ID, identifying document.
b. Attestation of the personal net incomes for the last three years.
3. For Bodily Injury Claims resulting in death, besides the ones mentioned above in point 1 and 2, shall be included even the below:
a. Death card
b. Death Certificate
c. District Court’s Verdict defining the legal heirs of the deceased.
4. For Bodily Injury Claims resulting in Permanent Disability, besides the ones mentioned above in point 1 and 2, shall be included even the below:
a. Permanent Disability Report, which expresses the degree of disability by percentage, based on the table on “Degree of Permanent Disability”
b. Radiography, scanner, magnetic resonance, case-history, check-in paper and check-out paper from the hospital and any other medical document that helps in the evaluation of the damage issued by the competent Authorities.
4. For Bodily Injury Claims resulting in Temporary Disability, besides the ones mentioned above in point 1 and 2, shall be included even Temporary Disability Report, which shall be in the Predefined model issued by the competent Authorities.

Documents that should be submitted in case of a Material Damage Claim
Documents in case of Material Damages are divided as below:
1. General Documents
a. Notification/Claim for indemnification of the damaged party registered in an Insurance Company
b. Confirmation of Insurance Cover, issued by the respective Insurance Company which has insured the liable vehicle.
c. The cons tat amiable or declaration of the event.
d. The Police Report on the occurrence issued by the competent Authorities the Road Traffic Police.
e. The Prosecution’s Office Verdict on the case, when from the accident resulted death and/or severe injuries.
f. The Verdict of the District Court, which defines liability over the accident , when one of the drivers of the vehicles involved in the accident results in death or severe injury, or the  Prosecution’s Office Verdict on the resting of the case.
2. Specific Documents
a. Attestation of ownership of the damaged vehicle or object.
b. Expert’s Report of the damage.
c. Photos of the vehicle liable for the accident.
d. Photos of the damaged vehicle or object.
